AstraZeneca has agreed to pay $8.5 million to settle a patent infringement lawsuit in which it is seeking to set aside the price of Crestor, the generic version of the drug.
The litigation is part of an effort by the Anglo-Swedish drugmaker to force Crestor, a cholesterol-lowering medicine, to be cheaper by lowering the drug’s cholesterol content.
The case is expected to go to trial in December, and in the US court system, the court will hear the case in March.
AstraZeneca is already facing allegations that it failed to properly disclose Crestor’s potential to lower cholesterol levels.
The company has also settled many patent-related litigation claims with the patent-holding firm of Sanofi SA.
AstraZeneca has been a major player in the heartburn drug since its launch in 2002.
In the case, a jury in New York found that AstraZeneca failed to adequately disclose the patent-infringing effects of Crestor, the company’s top-selling cholesterol-lowering drug.
The jury awarded the plaintiffs $10 million in damages, while $11.5 million was awarded to the defendants, which include Novartis AG, AstraZeneca’s research and development division and Sanofi-Aventis, a major player in the heartburn drug.
The trial is set to begin on December 3, but is expected to last about two weeks.
The jury also awarded the plaintiffs $9.5 million in damages to the plaintiffs, a result which is similar to that of the $8.5 million verdict in the previous month against AstraZeneca.

I am on 40 mg of Crestor and am taking 10 mg of Crestor daily. I am not sure if the Crestor comes out of the bottle or if it has anything to do with my heart. My doctor has prescribed Crestor but the generic Crestor is also the brand name.
